Privacy: Private Sector Extension
Legislation applying privacy and data protection regulation to the private sector took effect from 21 December 2001. AELA participated in the Attorney General’s Core Consultative Working Group for the development of Privacy Principles for the private sector, which preceded the legislation. To assist members comply with the new law, AELA developed a compliance strategy consisting of four phases: audit; review; changes to documents, operations and systems; and a training program. In implementing their compliance programs members identified a range of operational issues, and in response AELA prepared compliance assistance notes for members, and also prepared notes for distribution by members to their introducers to assist increased compliance awareness. AELA responded to the review by the Commissioner of the private sector provisions and welcomed the general conclusion that the provisions are working well and do not require amendment. The Government’s response to specific recommendations to address minor fringe issues is awaited, particularly for any potential impact on the issue of ‘bundled consents’.
